Barry Viprino Faces 44-Count Indictment After Other Alleged Rape Victims Come Forward

BARNSTABLE – Barry Viprino, who was arraigned in November on charges related to the alleged rape of three women, faces a slew of new charges after four more alleged victims came forward to investigators.

On Friday, a Barnstable County grand jury handed up a 46-count indictment against the 43-year-old Harwich resident for his role in the alleged rape and abuse of seven separate victims between May and November, 2023.

Viprino will be arraigned in Barnstable Superior Court on March 12 on one count of aggravated rape, 19 counts of rape, five counts of indecent assault and battery on a person over the age of 14, one count of kidnapping, two counts of assault with a dangerous weapon, two counts of witness intimidation, one count of possessing a large-capacity firearm, and 15 counts of possessing a large-capacity feeding device for a firearm. He remains in custody pending his next court date.

According to a statement released by Cape and Islands District Attorney Rob Gallibois' office, the Harwich police became aware of allegations of a sexual assault in August, and during the course of that investigation, two additional alleged victims came forward. At that time, he was arraigned in Orleans District Court and ordered held in lieu of $200,000 bail.

"Subsequently, additional victims have come forward to the Harwich Police Department. Today's return of indictments reflect charges involving all seven victims," the statement reads. "Upon the presentation of the indictments today...Barnstable Superior Court Judge [Thomas] Perrino issued a warrant to ensure that Mr. Viprino answers to these charges."

In the first case, the alleged victim reported going to Viprino’s home with her boyfriend on Aug. 29, and when the boyfriend left, Viprino allegedly showed a gun underneath his shirt and ordered the victim, who at the time was 17, to take off her clothes and lie on a couch in his office before allegedly sexually assaulting her. Prosecutors allege that during the assault, Viprino promised that he would buy the victim a house, a car and a supply of drugs.

A second woman alleged that she was “threatened and coerced” into having sex with Viprino, both in Viprino’s office and at the victim’s house, over several weeks last summer.

A third alleged victim was also sexually assaulted by Viprino, who allegedly threatened that the assaults would happen three times a week and told her “if she did not follow the rules, she would be in trouble,” prosecutors said at the time.

In conversation with the victims, Viprino also allegedly insinuated that he was involved in murder and gun running. On Sept. 25, Harwich police executed a search warrant of Viprino’s garage and office space. While no weapons were found, police uncovered several high capacity gun magazines, prosecutors said.

Viprino is a 1999 graduate of Nauset Regional High School, according to his attorney, Matthew Bober. He said Viprino, a former farmer, was unemployed and suffers from post traumatic stress disorder and seizures.
